Lesson Terms & Conditions
The Traditional Chinese version is the binding reference; this English page is a good-faith summary for convenience. In case of any discrepancy, the Chinese 受講規約 governs.
Scope & contract documents (Art. 1)
Applies to Snow-Wind Snowboard School (operator: Yukikaze Co., Ltd.（株式会社雪風）) lessons and related services. These terms, the course pages, the final-confirmation page, the Cancellation & Refund Policy, the Risk Disclosure & Participation Consent and the confirmation notice together form the contract. We do not use a “signed waiver” to exclude liability that law does not allow us to exclude.
How a booking forms (Art. 2)
Submitting a request does not by itself mean we have accepted it. The contract forms when we send a “booking confirmed” notice. Please check course, date, meeting time, resort, number of participants, total price, payment method and cancellation terms before submitting. A person booking for others must ensure each participant completes the required risk consent and health steps; minors: see Art. 13.
Price & payment (Art. 3)
Price, tax, peak-season surcharges and any other fees are shown clearly before you order. Payment is processed by Stripe; we do not retain full card numbers except where genuinely necessary. The full amount is payable in a single payment (no deposit or instalments).
Course content & coach assignment (Art. 4)
We set reasonable progression, content and routes based on goals, ability, safety, snow and on-site conditions. Unless your order guarantees a specific coach, we may substitute an equally qualified coach for illness, transport, safety or staffing reasons. We do not guarantee you will learn S-turns, carving, pass a certification, or reach any specific technical result within a set time.
Participant duties & honest information (Art. 5)
Provide truthful age, ability, safety-relevant health and emergency-contact information; follow Japanese law, resort and lift rules, and the coach’s reasonable safety instructions; do not participate under the influence of alcohol or drugs that impair judgement, reaction, balance or control.
Safety stop, grouping & adjustment (Art. 6)
We may adjust terrain, speed, content, grouping or range for safety. If a participant refuses reasonable safety instructions or endangers themselves or others, the coach may pause or stop their participation; fees are judged case-by-case, not as an automatic no-refund.
Equipment & belongings (Art. 7)
Use suitable equipment. You keep custody of phone, passport, cash, camera and other belongings; we are not liable for loss, theft or damage not attributable to us.
Insurance (Art. 8)
Our liability insurance (for our legal liability to third parties) is not the same as your personal accident, medical, travel or rescue insurance. We do not promise personal accident insurance for each participant unless a course page states so in writing. Overseas visitors should confirm their own cover for skiing/snowboarding, medical, rescue and personal liability. We do not advertise “all accidents are insured” or “guaranteed payout.”
Third parties, resort & external services (Art. 9)
Resort operations, lifts, patrol, third-party rentals, public transport and other skiers are the responsibility of their own operators. Lodging, flights, rail, bus, chartered transport and rental are not part of our lesson service (please arrange your own transport; we do not provide transfers).
Lateness, no-show, early exit (Art. 10)
Meeting time follows the confirmation notice. No-show, lateness or early exit for personal reasons is handled per the Cancellation & Refund Policy; any cancellation fee stays within the limits of Article 9 of Japan’s Consumer Contract Act. Lesson time runs from the agreed start time; if you ask the coach to help with rentals, gear setup or lift tickets, that time counts as lesson time and the end time is not extended.
Weather, snow, resort & uncontrollable events (Art. 11)
Snow, cold and normal visibility changes are ordinary winter conditions and are not automatic grounds for cancellation. If we cancel for safety, or the resort/lifts close so the core service cannot be provided, we reschedule or refund the portion not provided.
Cancellation, rescheduling & refunds (Art. 12)
Handled per the Cancellation & Refund Policy. Any cancellation fee is capped at the average damages ordinarily incurred (Consumer Contract Act Art. 9); any excess is refunded.
Minors (Art. 13)
Under-18 participants generally need consent from a person with parental authority or a legal representative (see Guardian Consent). A minor ticking a box does not count as guardian consent. 18- and 19-year-olds are treated as adults.
Personal data & images (Art. 14)
Handled per the Privacy Policy. Health/medical information is treated with separate explicit consent and limited to safety and emergency purposes. Marketing image use and marketing email are separate, non-pre-checked, optional consents; declining does not affect your booking.
Our responsibility (Art. 15)
We carry out the safety-management and duty-of-care required by law. We are liable under Japanese and other applicable mandatory law for damage caused by our (or our responsible personnel’s) intent, negligence, non-performance or tort. These terms do not exclude or limit liability for our intent or gross negligence, or any liability that law does not allow to be excluded. For the inherent risks of skiing/snowboarding, force majeure, third-party acts and a participant’s own fault, we do not automatically bear result-liability merely by providing instruction.
Resale, governing law, changes (Art. 16–18)
No commercial resale of course places without written consent. Governed by Japanese law — without excluding the mandatory consumer protections that apply to you; disputes go first to good-faith discussion, then to a Japanese court with jurisdiction, without excluding your statutory forum rights. If a clause is invalid, the rest remain effective; we do not stretch an invalid waiver to “the maximum extent permitted.”
Appendix: course-specific conditions (for safety)
- Lift tickets, gear rental, meals and transport are not included.
